This Terms of Use Agreement ("Agreement") governs your access to and use of the Cook GPT mobile application (the "App"), developed and operated by Playfulpixels Inc. ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by this Agreement. If you disagree with any part of this Agreement, you may not access or use the App.
We grant you a non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial purposes only. You may not:
The App may allow you to upload, submit, store, or transmit content ("User Content"). You are solely responsible for your User Content and the consequences of posting it.
You represent and warrant that you own all rights to your User Content or have obtained all necessary rights and licenses to use, store, and transmit it through the App.
The App may offer optional in-app subscriptions for premium features. Subscriptions are billed on a recurring basis (monthly or yearly) depending on your chosen plan. Payment will be charged to your Google Play Store or Apple App Store account at confirmation of purchase. Your subscription will automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period. You can manage your subscriptions and turn off auto-renewal through your account settings on the respective app store platform.
THE APP IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND FREEDOM FROM COMPUTER VIRUS. WE DO NOT WARRANT THAT THE APP WILL FUNCTION UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.
IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
We may terminate or suspend your access to the App at any time, for any reason, with or without notice.
This Agreement shall be governed by and construed in accordance with the laws of the State of [insert your state], without regard to its conflict of laws provisions.
This Agreement constitutes the entire agreement between you and us regarding your use of the App and supersedes all prior or contemporaneous communications and proposals, whether oral or written.
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
We may amend this Agreement at any time by posting the amended terms on the App. Your continued use of the App after the amended terms are posted constitutes your agreement to the amended Agreement.
